  1. Australian Consumer Law Prescribed Statement

    Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

  2. Introduction

    This Warranty is in addition to other rights or remedies that Buyer may have under the ACL in relation to the purchase of a Product.

  3. Definitions

    In this Warranty:
    1. “ACL” means the Competition and Consumer Act 2010 and Regulations.
    2. “Service Location” is where you deliver your Product to and collect it from for any servicing under this Warranty located at Unit 27, 5b Curtis Road, Vineyard, NSW 2765.
    3. “Consumable” includes (without limitation) labels, tapes, rollers;
    4. “LabelCity” means LabelCity Pty Ltd.
    5. “Product” means any products sold new by LabelCity on the Site and includes all LabelCity labels.
    6. “Materials” includes any informational or promotional material created and provided by LabelCity relating to a Product.
    7. “Purchase Date” means the date of first purchase of a Product from LabelCity.
    8. “Specifications” means the performance characteristics of a Product set out from time to time on LabelCity’s website.
    9. “You” means the Buyer of the Product.

  4. Warranty Terms

    LabelCity offers a Service Location Warranty on your Product subject to the following conditions:
    1. LabelCity warrants that your Product will be free from any defect in materials or workmanship for two (2) years after your Purchase Date.
    2. At its discretion, Label City will either repair or replace your Product, if it is found on inspection by LabelCity to have any such defect within the relevant warranty period.
    Manufacturers of Products sold on the Site may offer their own warranty or guarantees in relation to those Products. Any additional warranty or guarantee in relation to your Product (other than what is contained in the Specifications) about:
    1. a Product’s performance or fitness for any specific purpose; or
    2. the currency or application of any Materials, may be offered or provided by the manufacturers of those Products. The Buyer understand and agree that they may be required to direct their warranty claim to those Manufacturers rather than via LabelCity.

  5. For Buyers of DYMO Products

    Where a Buyer purchases products manufactured by DYMO from the Site, LabelCity agrees to provide this Warranty for those DYMO Products but only where DYMO determines and decides to exclude any repairs or replacement, when the Buyer does not use Consumables manufactured by DYMO and which were purchased from the Site. In these circumstances, you must follow the claim procedure in paragraph 5 below and also:
    • Confirm that the Buyer lodged a claim with DYMO and that claim was refused and to produce evidence of such refusal to repair or replace the Product; and
    • The Consumables were purchased from the Site.
    LabelCity will not be liable for any consequential loss or damage claimed to arise from your use of the Product. In particular (but without limitation) LabelCity will not be liable for actual or expected revenue loss or for any corruption or loss of data claimed to arise from your use of the Product.

  6. Warranty Claim Procedure

    If you wish to make a claim under this Warranty, you must do the following:
    • Call LabelCity on 1800 645 100 to notify them of your claim;
    • Return the Product, as far as possible in its original packaging, to the Service Location; and
    • Provide a copy of your purchase receipt, or other reasonably acceptable evidence of your Purchase Date, to show that this Warranty applies to your Product at the date of your claim.
    You may be required to pay the cost of delivering your Product to and collecting your Product from LabelCity Warranty service.

  7. Warranty Application

    Unless otherwise stated, this Warranty applies only to a Product sold by LabelCity;

  8. Warranty Exclusions

    This Warranty will not apply if any of the following events occurs in relation to your Product during the applicable warranty period stated above:
    • A Product’s serial number or any rating label is removed or changed in any way;
    • A Product is serviced or repaired by anyone other than a Service Agent;
    • The Buyer uses a Product contrary to the technical or operating environment guidelines recommended in the LabelCity user guide or manual;
    • A component part of the Product, (including but without limitation its waste pads), reaches the end of its service life; or
    • A Product’s malfunction or failure to perform according to LabelCity specifications results from:
      1. deliberate or accidental damage;
      2. neglect or modification by or on behalf of the Buyer; or
      3. the use of incorrect voltage or a power surge.
